R v Elliott
Broadway House criminal barrister Peter Hampton has successfully opposed an application by HM Attorney General for permission to refer the matter on account of an "unduly lenient" sentence being imposed.
The application was brought in relation to a community order made against the Defendant who qualified for a minimum term under section 111 of the Powers of the Criminal Courts (Sentencing) Act 2000. The Defendant relied upon the exceptional circumstances of the offender in light of the decision of the Court of Appeal (Criminal Division) in the case of R v Saw [2009] EWCA Crim 1, with particular reference to paragraph 27 of the Court's judgment.
