Possession with Intent to Supply - Paul Canfield Secures Acquittal for Father and Daughter

Paul was instructed by Mr Shaikh of Shaikh Solicitors to represent a father and his daughter in an allegation concerning possession with intent to supply a quantity of cocaine, which was located hidden within the family home.

It was quickly noted that a number of fingerprint marks linked a third suspect to the packaging of the drugs and that this suspect was arrested in suspicious circumstances and a number of mobile telephones were recovered.

These phones were requested at Plea and Trial Preparation by Paul and after repeated requests the defence were informed shortly before trial that the third suspects phones had not been reviewed nor retained.

As such, Paul drafted an Application to Stay Proceedings, and Applications to Exclude Character Evidence as well as Adduce Bad-Character of a Non-Defendant in preparation for the trial which then prompted a full review by the Prosecution.

As a result of their review, the Prosecution offered no evidence due to the disclosure issues that had been highlighted.
